CALLING FOR A POSTPONEMENT OF REFERENDUM  ON THE PROPOSED DISSOLUTION OF THE VILLAGE PURSUANT TO A CITIZEN’S PETITION

Whereas the Village of Spencer set a date for referendum of April 30,2020 for the vote on dissolution; and

Whereas the Governor of New York State by executive order 202.13 suspended all voting and elections until after June 1, 2020; and

Now, therefore be it

Resolved that the referendum vote be suspended until further notice.

PUBLIC NOTICE – 2020 Village Elections

NOTICE IS HEREBY GIVEN that the annual Village Election of the Village of Spencer, Tioga County, New York will be held in the Municipal Room at the Spencer Village Office at 41 Main Street on Wednesday, March 18, 2020 between the hours of 12:00 Noon and 9:00 PM for the purpose of electing the following:

For the one (1) Mayor position of (2) two years, the following candidate has been nominated:

Kenneth P. Sutfin, 13 Owego Street

For the two (2) Trustee positions of (2) two years, the following candidate have been nominated:

Timothy J. Goodrich, 71 West Tioga Street

Sean P. Rice, 7 Kennedy Street

All candidates have been nominated in accordance with the provisions of Article 15 of Election Law for the Village Offices by certificate of petition and nomination, and duly filed with the Village Clerk.

Resolution: Calling for a Referendum of the Proposed Dissolution of the Village Pursuant to a Citizen’s Petition

Resolution #1 of 2020:  

Calling for a Referendum on the

Proposed Dissolution of the Village Pursuant to a Citizen’s Petition

Whereas the New York state Reorganization and Citizen Empowerment Act provides for a process for citizens to petition for a public vote on dissolving or consolidating local governments; and

Whereas the Village of Spencer, located within the Town of Spencer, in New York State received on January 2, 2020, a citizen’s petition to call for a public referendum to dissolve the Village of Spencer government; and

Whereas the petition requires twenty-percent of the registered voters to sign the petition; and

Whereas there were 104 valid signatures out of 114; and

Whereas on January 11, 2020, the Village Clerk reviewed and certified the petition; and

Whereas, pursuant to law, the Village Board is required to pass a resolution calling for a referendum on the proposed dissolution within thirty days of the Village Clerk certifying the petition; and

Now, therefore be it

Resolved that that Spencer Board of Trustees on this day of February 3, 2020 hereby calls for a referendum on the proposed dissolution to be held on April 30, 2020 at the Village of Spencer Hall, 41 Main Street, Spencer, N.Y.  14883, between the hours of 12:00 Noon and 9:00 PM.
